Terms of Use, Delta K9 Academy

1. Acceptance of Terms

These Terms of Use (the "Terms") are a binding legal agreement between you and Delta K9 Academy LLC ("Delta K9 Academy," "we," "us," or "our"). By accessing, browsing, or otherwise using deltak9.frenchydigital.com (the "Site"), submitting any form, contacting us, purchasing a dog, enrolling in a training program, or booking any service, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, you must not use the Site or our services.

You represent that you are at least 18 years old and legally able to enter into this agreement.

2. Form Submissions, Communications & Contact Consent

When you voluntarily submit information to us through any form, quiz, booking flow, chat, email, SMS, or phone call on the Site, including, without limitation, your name, phone number, email address, address, payment details, and information about you, your household, or your dog, you expressly authorize Delta K9 Academy to retain and use that information to contact you and to respond to your inquiry, fulfill your request, and market related products and services to you by phone call, SMS/text message, email, or postal mail.

TCPA & California consent. By providing a telephone number, you consent under the federal Telephone Consumer Protection Act (47 U.S.C. § 227), California Business & Professions Code §§ 17538 to 17538.45, and the California Invasion of Privacy Act (Cal. Penal Code §§ 630 et seq.) to receive recurring autodialed or pre recorded calls and SMS messages from Delta K9 Academy at that number for transactional and marketing purposes. Consent is not a condition of purchase. Message and data rates may apply. Reply STOP to opt out of texts; email contact@deltak9academy.com to opt out of other channels. You may also have the recording of any call you place to us; we may record calls for quality and training, and your continued conversation constitutes consent under California's two party consent rule.

CAN SPAM. Marketing emails will include an unsubscribe link. Transactional messages about an existing order or booking may continue regardless of marketing opt out.

3. Services

Delta K9 Academy provides dog training, protection dog placement, boarding, daycare, grooming, and related services. Specific deliverables, pricing, schedules, and warranties are documented in each signed service agreement, which controls in the event of any conflict with these Terms.

4. Deposits & Payments

All deposits are non refundable and reserve a training slot or hold a specific dog. Balances are due per the schedule in your service agreement. Late payment may forfeit your reservation. All prices are listed in U.S. dollars and exclude applicable California sales tax unless stated otherwise.

5. Lifetime Support Warranty

Every board and train graduate is eligible for lifetime obedience tune ups at our facility, subject to scheduling and reasonable use. Coverage is for the originally enrolled dog and handler only and excludes new behavior issues caused by neglect, abuse, or third party trainers.

6. Protection Dog Placement

Protection dogs are placed only with handlers who complete our onboarding and handler coaching program. Buyers acknowledge the responsibilities of owning a trained protection dog, including local laws, liability insurance, and safe storage. Buyers are solely responsible for compliance with California Civil Code §§ 3342 et seq. (dog bite liability) and any municipal ordinances.

7. Health & Liability

Owners certify their dog is current on vaccinations and free of contagious illness at intake. Delta K9 Academy carries appropriate insurance but is not liable for pre existing conditions, normal training stress, or losses outside our reasonable control.

8. Financing

Financing is provided by third party lenders. Approval, rates, and terms are set by the lender. Delta K9 Academy is not a creditor and makes no representations about credit decisions. See financing options.

9. Media Release

Unless you opt out in writing, you grant Delta K9 Academy a non exclusive, royalty free, worldwide license to use photos and video of your dog (and incidental likenesses you submit) for marketing, training materials, and social media.

10. Intellectual Property

The Site, including all text, graphics, video, logos, and software, is owned by Delta K9 Academy or its licensors and is protected by U.S. and international intellectual property laws. You may not copy, reproduce, scrape, or create derivative works without our prior written consent.

11. User Conduct

You agree not to use the Site to (a) violate any law; (b) submit false, misleading, or another person's information without authorization; (c) interfere with the Site's security or operation; or (d) attempt unauthorized access to any account, system, or data.

12. Disclaimer of Warranties

THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY CALIFORNIA LAW, DELTA K9'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE WILL NOT EXCEED THE AMOUNT YOU PAID TO DELTA K9 IN THE TWELVE (12) MONTHS BEFORE THE CLAIM. WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. Nothing in these Terms limits liability that cannot lawfully be limited under California law.

14. Indemnification

You agree to indemnify and hold Delta K9 Academy harmless from any claim, loss, or expense (including reasonable attorneys' fees) arising out of your breach of these Terms, your misuse of the Site, or your violation of any law or third party right.

15. Governing Law & Venue

These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles. Except for actions seeking injunctive relief, any dispute arising out of or related to these Terms or the Site will be resolved exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction of those courts.

16. Informal Resolution

Before filing any claim, you agree to first contact us at contact@deltak9academy.com and attempt in good faith to resolve the dispute for at least thirty (30) days.

17. Changes to These Terms

We may update these Terms at any time by posting a revised version on this page with a new "Last updated" date. Material changes will be reasonably highlighted. Your continued use of the Site after changes are posted constitutes acceptance.
